Terms of use
By using this website or starting a consultation you agree to these terms. If you do not agree, do not use the online-care program. Nothing in these terms limits the rights you have as a patient under California or federal law.
What FarmaciaRx is
FarmaciaRx connects patients located in California with an independent, California-licensed prescriber for a telehealth consultation. If the prescriber decides treatment is appropriate, the prescription is sent to Farmacia Anaheim (California pharmacy licence PHY58862), which prepares and dispenses it. The website itself does not practice medicine or pharmacy; the prescriber and the pharmacy do, under their own licences.
Who can use the program
- You must be at least 18 years old.
- You must be physically located in California at the time of the consultation and when medication is shipped. We do not consult with, prescribe for, or ship to patients outside California.
- You must give truthful and complete information about your health, identity, and medications. A prescriber's decision depends on it, and false information can put your health at risk.
No guarantee of a prescription
Starting a consultation does not mean you will be prescribed anything. The prescriber may prescribe, decline, ask for more information, or refer you to in-person care. A consultation does not replace a relationship with a primary care provider.
Not for emergencies
This service is not for urgent or emergency care. If you think you are having a medical emergency, call 911 or go to the nearest emergency room.
Telehealth consent
By starting a consultation you consent to receive care by telehealth. Telehealth has limitations: the prescriber cannot physically examine you, technology can fail or be interrupted, and in rare cases information could be lost or accessed without authorization despite security safeguards. You may stop a consultation at any time. You have the right to receive the same information you would receive in person about your treatment, its risks, benefits, and alternatives.
Compounded medications
Some treatments are compounded, prepared by a licensed pharmacist for an individual patient under Section 503A of the Federal Food, Drug, and Cosmetic Act. Compounded drugs are not FDA approved, and the FDA has not evaluated them for safety, effectiveness, or quality. Where a treatment is compounded we say so, and we make no claim that it is equivalent to an FDA-approved product. Your prescriber will tell you whether a compounded or an FDA-approved product is being prescribed.
Payment, refunds and shipping
- The consultation is free. You are charged for medication only if a prescription is written and you accept it. Prices are shown before you accept.
- Because compounded medication is prepared for you individually, it cannot be returned or resold. If your order arrives damaged, or was not what was prescribed, contact us within 7 days and we will replace it or refund it.
- Medication ships only within California, to the address you verify. Someone may need to be present to sign for it.
- If we cannot fill a prescription for any reason, you will not be charged, or will be refunded in full.
Your account and communications
Keep your login private and tell us immediately if you think someone else is using it. By providing a phone number or email you agree we may contact you about your consultation, prescription, refills, and safety information. You can opt out of marketing messages at any time; care-related messages continue while you are a patient.
Acceptable use
Do not use the website to obtain medication for anyone other than yourself, to misrepresent your identity or location, to interfere with the site's operation, or for any unlawful purpose. We may suspend or end access for violations.
Intellectual property
The Farmacia name, logos, and the content of this website belong to their respective owners and may not be copied or used without permission, except as needed to use the service.
Limitation of liability
To the extent permitted by law, the website operator is not liable for indirect or consequential damages arising from use of the website. This does not limit the professional responsibility of the prescriber or the pharmacy for the care they provide, or any liability that cannot be limited under California law.
Governing law and disputes
These terms are governed by the laws of the State of California. Disputes will be resolved in the state or federal courts located in Orange County, California. If any part of these terms is found unenforceable, the rest remains in effect.
Changes
We may update these terms; the current version is always posted here with its effective date. Continued use after a change means you accept it.
